This Privacy Policy explains how JCS BY JENN, doing business as Moda Digital AI ("we," "us," or "our"), collects, uses, shares, and protects personal information from people who visit modadigitalai.com, message us through social media or messaging platforms, or engage our AI automation services.

We operate from California, United States. This policy is governed by California law, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and the California Online Privacy Protection Act (CalOPPA).

We do not collect sensitive personal information as defined by the CPRA. Accordingly, the right to limit the use of sensitive personal information does not apply.

From third parties — advertising and messaging platforms (Meta, Google), our CRM, and automation tools.

3. How we use your information

Respond to your messages, quote requests, and inquiries.
Provide, maintain, and improve our AI automation services.
Send you communications about services you purchased or requested.
Send you marketing communications where you have authorized it. You may opt out at any time.
Measure the performance of our website and advertising campaigns.
Show you relevant advertising on third-party platforms, including Meta (Facebook and Instagram).
Prevent fraud, abuse, and unauthorized activity.
Comply with legal, tax, and accounting obligations.

We do not use your information to make automated decisions that produce legal effects concerning you.

We share personal information with service providers that act on our instructions and are bound by contractual confidentiality obligations:

About "selling" and "sharing" personal information.

We do not sell your personal information for money. However, under the CPRA's broad definition, the use of third-party advertising tools — such as Meta pixels and custom audiences — may constitute "sharing" personal information for cross-context behavioral advertising.

You have the right to opt out of this at any time. See Section 6.

5. How long we keep your information

We retain personal information only as long as necessary for the purposes described above, unless a longer period is required or permitted by law. These are the criteria we apply:

Prospects who did not purchase: for as long as commercial follow-up remains relevant. We delete them once the conversation goes inactive or when you ask us to.
Customers: for the duration of the business relationship and afterwards for as long as applicable tax and accounting obligations require.
Browsing records: the retention period applied by each analytics or advertising provider we use.

6. Your California privacy rights

If you are a California resident, the CCPA/CPRA gives you the following rights:

Right to know — what categories and specific pieces of personal information we have collected about you, where it came from, why we collected it, and who we share it with.
Right to delete — request that we delete the personal information we hold about you, subject to the exceptions the law allows.
Right to correct — ask us to correct inaccurate personal information.
Right to opt out of sale or sharing — tell us to stop sharing your information for cross-context behavioral advertising.
Right to non-discrimination — we will not deny you services, charge you different prices, or provide you a lower level of service for exercising your rights.
Right to limit use of sensitive personal information — not applicable to us, because we do not collect sensitive personal information.

How to exercise your rights

Email us at info@modadigitalai.com with the subject line "California Privacy Request," stating which right you wish to exercise.

We will respond within 45 calendar days. If we need more time, we will notify you and may extend by up to an additional 45 days, as permitted by law.

Identity verification. Before fulfilling a request, we must reasonably verify that you are who you say you are. We may ask you to confirm information already in our records. We will not use that information for any other purpose.

Authorized agents. You may designate someone to exercise your rights on your behalf. We will require written proof of authorization and may verify your identity with you directly.

Opt-out preference signals (Global Privacy Control)

We honor the Global Privacy Control (GPC) signal. If your browser or extension sends it, we will treat it as a valid request to opt out of sharing your personal information for behavioral advertising, without any need to contact us.

Do Not Track

As required by CalOPPA, we disclose that our website does not respond to browser "Do Not Track" signals, because no uniform standard exists for interpreting them. We do honor the GPC signal described above.

Shine the Light (California Civil Code § 1798.83)

California residents may request once per year a list of third parties with whom we shared personal information for those third parties' own direct marketing purposes during the preceding calendar year. We do not share personal information with third parties for their direct marketing purposes. You may request written confirmation at info@modadigitalai.com.

7. Cookies and tracking technologies

We use first-party and third-party cookies to operate the site, remember your preferences, measure traffic, and evaluate the performance of our advertising. You can configure your browser to block or delete cookies; some site features may stop working correctly.

Third parties that place cookies through our site may collect information about your activity on other websites over time. See Section 6 to exercise your opt-out right.

8. Children

Our services are directed to adults 18 and over in a business context. We do not knowingly collect personal information from anyone under 16, and we do not sell or share their information. If you believe a minor has provided us with personal information, contact us and we will delete it.

9. Security

We maintain reasonable security measures — access controls, encryption in transit, and limiting authorized personnel — appropriate to the nature of the information we handle. No system is completely secure, and we cannot guarantee absolute security.

10. Users outside the United States

We serve clients in Mexico and other Latin American countries. If you contact us from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those of your country.

If you are located in Mexico, this policy also serves as a privacy notice under the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP). You may exercise your ARCO rights (access, rectification, cancellation, and objection) through the same email address listed above.

11. Changes to this policy

We may update this policy when our practices or applicable law change. We will post the current version at this same address and update the date in the header. If the changes are material, we will notify you through a prominent means.
